ORLANDO — A Orlando homeowner is suing an insurance company, alleging refusal to apply payments for hurricane damage.

Liliana Gomez filed a complaint Aug. 20 in Orange Circuit Court against Avatar Property & Casualty Insurance Company, alleging failure to issue payment based on the damage estimate.

According to the complaint, on Sept. 11, 2017, Gomez's insured property at 10445 Montpelier Circle, Orlando, sustained physical damage as a result of Hurricane Irma.

Gomez says her contract with Avatar was in full force and effect during the damage, and that she timely filed notice of the loss but has failed to receive the correct amount covered under the policy.

The plaintiff alleges Avatar Property & Casualty Insurance has failed to provide complete coverage for the physical damages that occurred during the contract period.

Gomez seeks trial by jury, damages in excess of $15,000, plus interest, attorney fees and court costs. She is represented by attorney Andrew M. Bragg of Kanner & Pintaluga PA in Tampa.
