Customer alleges Burger King negligence led to injuries

ORLANDO — An Orange County woman is suing Burger King, alleging negligence led to injuries for the plaintiff.

Lourdes Cosme of Windermere filed a complaint Aug. 15 in Orange County Circuit Court against Sun Holdings Inc., doing business as Burger King, alleging the restaurant operator failed to maintain its premises in a reasonably safe condition for use by its invitees.

According to the complaint, on Oct. 28, 2017, Cosme was lawfully at the Burger King, 4622 S. Kirkman Road, Orlando, when she stepped into an open drain on the floor. She says she fell heavily and sustained injuries in and about her body and extremities, resulting in pain and suffering, disability, disfigurement, scaring, mental anguish and loss of the capacity for the enjoyment of life. 

The plaintiff alleges Burger King failed to adequately maintain the floor and failed to warn its invitees of any known hazards or hazardous conditions.

Cosme seeks trial by jury, damages that exceed $15,000, exclusive of interest, court costs and attorney fees. She is represented by attorney Logan J. Young of Dan Newlin & Partners in Orlando.
