Orlando homeowners allege insurer failed to cover hurricane damage

ORLANDO — Two Orlando homeowners are suing an insurer, alleging breach of an insurance contract.

James Russo and Mary Russo filed a complaint Aug. 15 in Orange County Circuit Court against Universal Insurance Company of North America, alleging failure to pay for damages caused by a hurricane.

According to the complaint, on Sept. 11, 2017, while the Russo property at 3702 Narroline Drive, Orlando, was insured by Universal, it sustained a covered loss due to Hurricane Irma, which caused sudden and accidental damage to the property. Although the defendant accepted coverage for the claim, the suit says, it grossly undervalued the extent of the damages as a result of the loss, causing the plaintiffs to suffer monetary damages. 

The plaintiffs allege Universal Insurance has failed to pay the full amount of the claim, and forced the Russos to retain the services of counsel to prosecute legal action.

The Russos seek trial by jury, damages of more than $15,000, pre-judgment interest, attorney fees, court costs and all other fair relief. They are represented by attorneys Harold Levy and Elizabeth Mitchell of HL Law Group PA in Fort Lauderdale.
