CLEARWATER — A Madeira Beach homeowner is suing an insurance company, alleging refusal to apply payments for hurricane damage.
Kathleen Kumar filed a complaint Aug. 9 in Pinellas Circuit Court against Citizens Property Insurance Corporation, alleging breach of an insurance contract by failing to pay coverage for the plaintiff's losses.
According to the complaint, on Sept. 10, 2017, Kumar's property at 515 Johns Pass Ave., Madeira Beach, sustained damages from Hurricane Irma that are covered under a homeowners insurance policy. Kumar says the insurance policy from Citizens Property was in full force and effect during the incident, and she complied with all conditions precedent to entitle her to recover under the policy.
However, Kumar says she was denied insurance benefits needed to cover the losses. The plaintiff alleges Citizens Property Insurance has failed and refused to pay for all Kumar's losses.
Kumar seeks trial by jury, damages of more than $15,000 for all covered losses with interest on any overdue payments, attorney fees and court costs. She is represented by attorney Seth Kerr of Morgan & Morgan Tampa, PA in Tampa.
