Assisted living facility cited in resident's death

CLEARWATER — A family member is suing a Pinellas County assisted living facility, alleging breach of duty, negligence and wrongful discharge.

Charles W. Alderman, personal representative for Homer Alderman, filed a complaint Aug. 9, in Pinellas County Circuit Court against Summerville 9 LLC, Summerville Investors LLC, Summerville Senior Living Inc., et al, alleging they breached professional standards of care and treatment.

According to the complaint, Homer Alderman was a resident of the defendants' Brookdale Beckett Care in Clearwater. The suit says he sustained bodily injuries, including multiple falls, skin integrity issues, skin tears and a coccyx red area, resulting pain and suffering, disability, disfigurement, mental anguish, loss of enjoyment of life, medical expenses and aggravation of a previously existing condition that ultimately led to his death March 12, 2017. 

The suit alleges Homer Alderman's condition resulted from the defendants' negligence in the proper care, treatment and monitoring of the decedent while he was residing at Brookdale Beckett Care. 

The plaintiff alleges the defendants failed to protect Homer Alderman from falling and being injured, failed to provide proper assessment of his needs and failed to monitor signs and symptoms of changes in Alderman.

Charles Alderman seeks trial by jury, damages of more than $15,000, disgorgement of profits, attorney fees and court costs, pre-judgment interest, the opportunity to add a demand for punitive damages, plus all other appropriate relief. He is represented by attorney Lisa M. Tanaka of Wilkes & McHugh PA in St. Petersburg.
