Customer alleges Fancy Fruit's negligence led to fall, injuries

ORLANDO — A customer is suing an Orlando fruit and produce store, alleging negligence led to injuries for the plaintiff.

Ileana Arroyo filed a complaint Aug. 9 in Orange County Circuit Court against Fancy Fruit and Produce Inc., alleging the defendant failed to maintain the aisles for business invitees.

According to the complaint, on July 5, 2017, Arroyo was lawfully at Franc Fruit and Produce, 2211 Goldenrod Road, Orlando. The suit says Arroyo slipped and fell on a liquid substance that had been allowed to remain on the floor by Fancy Fruit employees. 

Arroyo also alleges that at the time incident, multiple Fancy Fruit employees were in the immediate vicinity of the substance, yet none gave any warning or took any corrective action with regard to the liquid. 

The plaintiff alleges Fancy Fruit and Produce failed to inspect the area where the accident occurred to ensure it was in a reasonably safe condition for its intended and foreseeable uses, and failed to adequately warn invitees that the area was in a dangerous or unreasonably safe condition and posed a danger for harm.

Arroyo seeks trial by jury, damages in excess of $15,000, plus interest, costs, and all other necessary and proper relief. She is represented by attorney Daniel P. Osterndorf of Pardy & Rodriguez, PA in Orlando.
