CLEARWATER — A tourist is suing Universal Studios, alleging negligence caused the plaintiff to fall and sustain injuries.
Kenneth Lowe filed a complaint Aug. 9 in Orange County Circuit Court against Universal City Development Partners LTD, doing business as Universal Studios Florida and/or Universal Orlando, alleging failure to use reasonable care in the design, construction and maintenance of the premises in order to provide safety for business invitees.
According to the complaint, on April 7, 2017, Kenneth Lowe was lawfully at Universal Studios Florida when he tripped and fell due to the existence of a dangerous and hazardous condition near the entrance to the "Amazing Adventures of Spiderman" ride.
As a result, Lowe says, he sustained physical injuries, mental anguish, and the expense of hospitalization and medical and nursing care treatment.
The plaintiff alleges Universal Studios Florida failed to design and construct the landscape planter curbing by allowing it to extend well beyond the planted landscape elements into the natural path of foreseeable pedestrian traffic.
Lowe seeks trial by jury, damages in excess of $15,000 for costs, interest and attorney fees. He is represented by attorney Michael K. Bailey of Bailey Fisher, PLLC in Winter Park.
