Visitor alleges Orlando property owner's negligence led to 10-foot fall

ORLANDO — A Miami-Dade County man is suing an Orlando property owner, alleging negligence led to the plaintiff falling through a bathroom roof.

Bryan Scott Vieten filed a complaint Aug. 8 in Orange County Circuit Court against Simon Property Group LP, doing business as Orlando Premium Outlets-International Drive, alleging failure to maintain its premises in a reasonably safe condition.

According to the complaint, on July 12, 2016, Vieten was an invitee at Orlando Premium Outlets when he fell straight through a bathroom roof and landed 10 feet below on the ground. The suit says Vieten suffered injuries, resulting in pain of body and mind, medical expenses, loss of earnings and disability. 

The plaintiff alleges Orlando Premium Outlets-International Drive failed to inspect its property and failed to warn Vieten of the existing danger.

Vieten seeks trial by jury, damages of more than $15,000, exclusive of interest, court costs and attorney fees. He is represented by attorney Daniel F. Kaufman of Asnis, Srebnick & Kaufman in Sunrise.
