Visitor alleges Maitland property owner's negligence caused injuries lifting pergola

ORLANDO — A Maitland man is suing a neighbor, alleging negligence caused injuries to the plaintiff.

Tyrone R. Bowie filed a complaint Aug. 8 in Orange County Circuit Court against Mitchell Rice, alleging the defendant negligently failed to lift his side of a pergola.

According to the complaint, on April 20, 2017, Bowie was an invitee on Rice's property, 629 Lake Shore Drive, Maitland. The suit says while Bowie was helping Rice to lift a pergola, he ripped his left bicep. 

Bowie says he has sustained medical expenses, physical handicap, mental anguish, lost wages and impairment in earning capacity. The plaintiff alleges Rice is responsible because the defendant carelessly dropped his end of the pergola, putting sudden pressure on Bowie's side.

Bowie seeks trial by jury, damages that exceed $15,000, exclusive of interest or court costs. He is represented by attorney Armando R. Payas of Payas, Payas, & Payas, LLP in Orlando.
