Orlando property owner alleges insurance company failed to pay for water damage

ORLANDO — An Orlando policy holder is suing a liability insurer, alleging breach of an insurance contract.

Sandra Martinez Peralta filed a complaint Aug. 8 in Orange County Circuit Court against Heritage Property & Casualty Insurance Company, alleging failure to tender an appropriate amount to repair the plaintiff's damaged property.

According to the complaint, on Aug. 2, 2017, while the Heritage policy was in full force and effect, Peralta's  property at 573 Southern Charm Drive, Orlando, sustained a covered loss due to a water event. 

As a result of defendant's breach, Peralta says she has suffered and continues to suffer damages. The plaintiff alleges Heritage Property & Casualty Insurance has failed to adequately indemnify her loss.

Peralta seeks trial by jury, damages of more than $15,000, exclusive of interest, court costs and attorney fees. She is represented by attorney Louis A. Gonzalez of Vargas Gonzalez Hevia Baldwin, LLC in Winter Park.
