Orlando shopping center landlord alleges nutrition store failed to pay rent

ORLANDO — An Orlando business property owner is suing a nutrition business, alleging breach of a commercial lease agreement.

Brixmor/IA Colonial Marketplace LLC filed a complaint Aug. 8 in Orange County Circuit Court against Fitspo Nutrition, Inc. and Adam Brocious, alleging they failed to pay all rent and other sums due in accordance with the lease.

According to the complaint, on Feb. 28, 2017, Brixmor granted the defendants the right to use and occupy the commercial space known as Store No. 5 in the Shopping Center at 2931 E. Colonial Drive, Orlando. 

On July 26, 2018, the suit says, as a result of the defendants' default, Brixmor provided written notice to the defendants, demanding payment of the rent or possession of the premises. 

The plaintiff alleges Fitspo Nutrition and Brocious have failed to pay rent and other charges and failed and refused to relinquish possession of the premises.

Brixmor/IA Colonial Marketplace seeks trial by jury, damages of more than $15,000, exclusive of interest, costs and attorney fees and possession of the premises. It is represented by attorneys James Austrich and Brian C. Willis of Shumaker, Loop & Kendrick, LLP in Tampa.
