Ocoee property owner alleges insurer failed to pay for hurricane damage

ORLANDO — An Ocoee property owner is suing an insurance company, alleging refusal to apply payments due to hurricane damages.

Gaye-Ann Thompson filed a complaint  Aug. 1 in Orange County Circuit Court against American Integrity Insurance Company alleging that the defendant has neither acknowledged coverage nor denied coverage.

According to the complaint, on Sept. 10, 2017, Thompson's property at 1279 Vickers Lake Drive, Ocoee, suffered sudden and immediate physical damages and covered loss due to Hurricane Irma while the policy was in full force and effect. American Integrity Insurance acknowledged the claim, the suit says, and under the material terms of the policy, the defendant undertook an obligation to adjust all losses. 

However, more than four months after the defendant received notice of the loss, it allegedly has neither acknowledged coverage nor denied coverage in writing, and has apparently taken the position that it has no specific time or duty within which to perform its obligation to adjust the loss. As a result, Thompson says, she continues to suffer due to her property's damages. 

Thompson seeks trial by jury, a declaratory decree establishing that a covered loss has occurred, damages in excess of $15,000, plus costs, interest, attorney fees and all other just and proper relief.
