Customer alleges Subaru sold defective vehicle

ORLANDO — A customer is suing Subaru, alleging breach of a written warranty.

Avril Lindsay Dennis filed a complaint Aug. 1 in Orange County Circuit Court against Subaru of America Inc., alleging violation of the Magnuson-Moss Warranty Act.

According to the complaint, on Dec. 18, 2017, Dennis purchased a Crosstrek vehicle from Subaru for $23,249.97. The suit says shortly thereafter the Croostrek experienced various defects that substantially impaired its use, value and safety. 

Dennis says she she delivered the Crosstrek to the manufacturer, through its authorized dealership network, on numerous occasions. However, the suit says, the Crosstrek has not been brought back to the quality of its implied warranties and cannot be utilized as intended at the time of acquisition. 

Dennis says she continues to be financially damaged for not being able to use the vehicle that she purchased. 

The plaintiff alleges Subaru of America failed to adequately repair the defects in Dennis' Crosstrek as provided in the manufacturer's warranty.

Dennis seeks trial by jury, damages in excess of $15,000 for the diminution in value of the vehicle, attorney fees, witness fees, all court costs and all further just and appropriate relief. She is represented by attorney Rachel E. Maltese of Krohn & Moss Ltd. in Chicago.
