Consumer alleges negligence by pot's manufacturer, distributor led to injuries

ORLANDO — A consumer is suing a pot manufacturer and Walmart, alleging breach of implied warranty or merchantability, product liability, negligence and strict liability.

Leila Davis filed a complaint Aug. 1 in Orange County Circuit Court against Meyer Corporation and Walmart Inc., alleging they obtained profit through distribution of a substandard product that injured the plaintiff..

According to the complaint, on March 17, 2017, Davis was using a Faberware 5-quart durable stainless steel pot that was purchased from Walmart to cook shrimp. The suit says the handle of the pot broke, allowing boiling water to over Davis. 

Davis said she suffered burns on her stomach, right leg, and right foot, and was subjected to medical treatment that cost $1,935. 

The plaintiff alleges Meyer and Walmart failed to take action to remedy the pot’s defects or warn consumers about the pot’s defective and unreasonably dangerous condition, failed to properly design the pot to carry the weight of food, and failed to adequately test or inspect the pot prior to placing it into the stream of commerce.

Davis seeks trial by jury, judgment for all injuries, damages, court costs, and interest. She is represented by attorney Steven E. Nauman of Morgan & Morgan PA in Orlando.
