Burger King customer alleges negligence caused fall, injuries

ORLANDO — A customer is suing Burger King, alleging negligence caused her to fall and sustain injuries.

Jackie Adams filed a complaint July 30 in Orange County Circuit Court against Sun Holdings Inc., doing business as Magic Burgers / Burger King, alleging the defendant failed to reasonably maintain the premises safe for business invitees.

According to the complaint, on Aug. 16, 2017, Adams was lawfully at the defendant's Burger King restaurant in Winter Prk. The suit says Adams tripped and fell on an unmaintained hole in the brickwork at the entrance of the restaurant. 

Adams says during her fall, multiple Burger King employees were in the immediate vicinity of the deteriorated surface; yet none gave any warning or took any corrective action with regard to the substance of the hazard. 

The plaintiff alleges Burger King failed to inspect the area where the accident occurred to ensure that it was in a reasonably safe condition for walking, and free from all defects and conditions that would render it dangerous and unsafe to the public.

Adams seeks trial by jury, damages in excess of $15,000, plus costs, and all other necessary and proper relief. She is represented by attorney Louis C. Thomas of Pardy & Rodriguez PA in Temple Terrace.
