Couple alleges LA Fitness allowed facility to have legionella bacteria

ORLANDO — An Orlando couple is suing LA Fitness, alleging negligence in keeping the premises clean and safe for use by members.

Peter Bussinger and Ruby Bussinger filed a complaint July 30 in Orange County against Fitness International, LLC, also known as LA Fitness, alleging failure for the inspection, maintenance and upkeep of the fitness center, resulting in positive signs of legionella bacteria in the property.

According to the complaint, on May 28, 2017, Peter Bussinger was exposed to the legionella bacteria during his visit at LA Fitness' Club, 4792 S. Kirkman Road, Orlando. Bussinger, the suit says, was a regular user of the club's pool, spa, and showers, and was admitted to the hospital.

After a series of pathological and diagnostic testing, the lawsuit states, he was diagnosed with legionnaires disease. 

Furthermore, the suit says, the Florida Department of Health inspected and tested areas in the defendant's Orlando fitness club and found positive signs of legionella. As a result, the couple says they havesuffered expenses of hospitalization, inconvenience and loss of earnings. 

The plaintiffs allege LA Fitness failed to maintain or adequately maintain the showers, water fountains, spas, pools and water fixtures within the club, which allowed the legionella to develop and proliferate while members are utilizing the premises.

The Bussingers seek trial by jury, damages in excess of $15,000, plus interest, costs and all other proper relief. They are represented by attorney Jason J. Recksiedler of NeJame Law PA in Orlando.
