Broward County property owner alleges insurer refused to cover hurricane damages

FORT LAUDERDALE — A Fort Laderdale property owner is suing an insurer, alleging refusal to apply payments for a property's covered loss due to a hurricane.

Mattie Merritt filed a complaint July 30 in Broward County Circuit Court against Florida Peninsula Insurance Company, alleging the defendant has failed and refused to pay any insurance benefits for a covered loss.

According to the complaint, on Sept. 10, 2017, her insured property at 2816 NW Seventh Court in Fort Lauderdale suffered damages due to hurricane Irma while the policy was in full force and effect. Merritt says she timely notified Florida Peninsula Insurance about the loss, and that the insurer acknowledged the claim and inspected the property. 

However, Florida Peninsula allegedly denied coverage and has refused to pay any benefits for the covered loss. As a result, Merritt says she has suffered and continues to suffer for the property's damages. 

The plaintiff alleges Florida Peninsula Insurance has failed and refuses to pay any insurance benefits for the covered loss, which is due and owing.

Merritt seeks trial by jury, damages exceeding $15,000, exclusive of costs, interest, attorney fees and all other just and proper relief. She is represented by attorney Kimesha S. Smith of Insurance Litigation Group PA in Miami.
