Parent claims employees responsible for child's accident at Discovery Middle School

ORLANDO — A parent is suing Orange County School Board for more than $15,000 in damages, after a student was seriously injured in an accident at Discovery Middle School.

Emanuella Nelson filed a complaint on July 25, in the 9th Judicial Circuit Court of Florida - Orange County, against Orange County School Board, alleging that the school board failed to provide a safe and secure environment.

According to the complaint, the plaintiff alleges that, on August 24, 2017, her minor child sustained serious injuries and damages, resulting in pain and suffering, disability, disfigurement, permanent and significant scarring, mental anguish, loss of enjoyment of life, and medical expenses.

The plaintiff claims the accident was a result of the negligence of employees at Discovery Middle School, located at 601 Woodbury Road, Orlando. The child was injured while in the custody and care of the defendant, according to the lawsuit.

The plaintiff holds Orange County School Board responsible because the defendant allegedly failed to adequately inspect the area for dangerous conditions, failed to warn plaintiff to avoid the hazardous premises, and failed to properly train its employees to prevent such dangerous condition of the premises.

The nature of the accident was not detailed in the complaint.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages and demands judgment in excess of $15,000, plus interest and costs. She is represented by Andres I. Beregovich of The Beregovich Law Firm PA in Orlando.
