Motorist seeks more than $15,000 in damages, claiming Orlando car accident left him disabled

ORLANDO — A motorist is seeking more than $15,000 in damages from a car accident that he claims left him seriously injured and disabled.

Angel L. Rosario-Burgos filed a complaint on July 25, in the 9th Judicial Circuit Court for Florida, Orange County, against Kimberly Xavayong alleging, that the motorist failed to exercise standard care and skill in the operation of a vehicle.

According to the complaint, the plaintiff alleges that, on December 18, 2017, he suffered bodily injury and resulting pain and suffering, disability, loss of capacity for the enjoyment of life, medical care and treatment, and loss of earnings, as a result of the carelessness of the defendant in operating her automobile that collided with the vehicle driven by plaintiff on or near Crystal Creek Boulevard and John Young Parkway in Orlando. 

The plaintiff holds Kimberly Xavayong responsible because the defendant allegedly failed to pay attention to traffic and keep a proper lookout for other vehicles, and failed to maintain proper speed and distance between vehicles to avoid collision.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages, costs and for such other and further relief as the Court deems necessary. He is represented by Louis C. Thomas of Pardy & Rodriguez PA in Temple Terrace.
