Homeowner sues People's Trust Insurance Co.

CLEARWATER — A homeowner is suing People's Trust Insurance Co., citing alleged breach of contract.

Jeffrey Lafay filed the complaint on July 27, in the 6th Judicial Circuit Court of Florida - Pinellas County, against People's Trust Insurance, alleging that the insurer breached its duty of good faith and fair dealings.

The plaintiff alleges that he has suffered damages to his insured property located at 2408 NavaIez Ave., Safety Harbor, in Pinellas County, caused by a "covered peril" in the insurance policy, according to the complaint. However, the defendant has breached the policy by failing to pay all benefits due, the claim states. 

The plaintiff holds People's Trust Insurance responsible because the defendant allegedly breached the policy by underpaying and/ or undervaluing the claim, failed and/or refused to properly investigate the loss, and failed and/or refused to tender all insurance proceeds due and owing to plaintiff, according to the claim.

The plaintiff requests a trial by jury and seeks judgment against defendant for award of compensatory and contractual damages, pre-judgment interest, costs of this action, attorneys’ fees, and such further relief as the court may deem appropriate.
