Dania Beach homeowner alleges insurer failed to pay for water damage

FORT LAUDERDALE — A Dania Beach property owner is suing an insurer, alleging refusal to apply payments for a covered loss.

Digna Montoya filed a complaint July 23 in Broward County Circuit Court against Universal Property and Casualty Insurance Company, alleging refusal to provide full coverage for a damaged property under the defendant's policy.

According to the complaint, on Jan. 27, Montoya property at 191 NE Sixth Court, Dania Beach, was damaged by water and suffered direct physical damage and loss while the policy was in full force and effect. 

Montoya says she made a timely claim for the loss and has performed all requirements necessary. However, Universal Casualty allegedly has failed and refuses to fully pay for the covered loss. As a result, Montoya says, she has been financially damaged and continues to suffer damages and loss. 

The plaintiff alleges Universal Property and Casualty Insurance has failed and refuses to pay full coverage for the damages of the insured Dania Beach property.

Montoya seeks trial by jury, damages in excess of $15,000, exclusive of costs, interest, reasonable attorney fees and all other just and proper relief. She is represented by attorneys Andrew P. McDonald and David D. Barnhill of McDonald & Barnhill PA in Tampa.
