FORT LAUDERDALE — A Miami-Dade County woman is suing a recycling solutions company, alleging retaliation and wrongful termination.
Raylin Lynette Burke filed a complaint July 18 in Broward County Circuit Court against Waste Management Inc. of Florida, alleging violation of the Florida Civil Rights Act of 1992.
According to the complaint, on Oct. 4, 2016, Burke, who had worked for Waste Management as a scale house clerk since July 18, 2016, slipped and fell at work and injured her left knee, left hip and lower back.
Burke says after operations manager Juan Garcia was called out by management for not following protocol to process Burke's worker's compensation, Garcia allegedly began to retaliate and harass her, which she has reported twice. The suit says nothing was done.
On Oct. 2, 2017, Burke says she was notified that she was being terminated for five accumulated absences because her injury, despite Waste Management's full knowledge of the reason for her absences.
The plaintiff alleges Waste Management of Florida allowed discrimination, harassment and retaliation to continue in the workplace by failing to make prompt remedial action to prevent unlawful treatment and eventually terminated Burke.
Burke seeks trial by jury, damages of more than $15,000, costs, injunctive relief, plus front wages, and any other just and proper relief. She is represented by attorney Anthony M. Georges-Pierre of Remer & Georges-Pierre, PLLC in Miami.
