Oakland Park homeowners allege insurance firm failed to cover roof damage

FORT LAUDERDALE — Two Oakland Park property owners are suing an insurance company, alleging breach of an insurance contract.

Sarah Jane Turner and David Nagle filed a complaint July 17 in Broward County Circuit Court against United Property and Casualty Insurance Company, alleging wrongfully refusing to pay the plaintiffs' covered losses.

According to the complaint, on Sept. 11, 2017, the home of Turner and Nagle, 1744 NW 36th Court, Oakland Park,  suffered roof damage due to Hurricane Irma. 

Turner and Nagle say they have performed all condition precedent to entitle them to recover losses but they have failed to receive compensation under the homeowners insurance coverage afforded them and as agreed to by the defendant. 

The plaintiffs allege United Property and Casualty Insurance failed to perform all conditions precedent to properly deny the plaintiffs' homeowners claim covered under the policy.

The plaintiffs seek trial by jury, damages that exceed $15,000, plus costs, interest, pre-and post-judgment interest, attorney fees and all other further relief the court deems appropriate. They are represented by attorney Steven Ainbinder of The Offices of Berman & Berman, PA in Boca Raton.
