Pembroke Pines property owner alleges insurance company failed to pay for hurricane damage

FORT LAUDERDALE — A Pembroke Pines property owner is suing Citizens Property Insurance Corp., alleging breach of an insurance contract.

John L. Wynkoop filed a complaint July 13 in Broward County Circuit Court against Citizens Property Insurance Corp. alleging failure to pay the plaintiff’s full loss according to the terms of the insurance contract.

According to the complaint, on Sept. 10, 2017, Wynkoop's property at 2250 Oak Court, Pembroke Pines, was damaged by Hurricane Irma. At the time of the loss, the suit says, his property was insured by Citizens Property, for which he has claimed payment for the full value of the loss. 

The plaintiff alleges Citizens Property Insurance, despite admitting liability for the loss, has failed to adequately pay Wynkoop's loss.

Wynkoop seeks trial by jury, seeks damages of more than $15,000, with interest, attorney fees, costs and all other just and appropriate relief. He is represented by attorneys Jeremy F. Tyler, W. Wyndham Geyer Jr. and Andrew Fuxa of Geyer Fuxa Tyler in Sunrise.
