Customer alleges Wal-Mart's negligence led to fall, injuries

CLEARWATER — A Pinellas Park couple is suing Wal-Mart, negligence in keeping its property safe.

Joni Vanwagner and John Vanwagner filed a complaint July 16 in Pinellas County Circuit Court against Wal-Mart Stores Inc. alleging the defendant failed to provide customers reasonably safe accommodations with reasonable security measures.

According to the complaint, on April 28, 2016, Joni Vanwagner was lawfully at the Wal-Mart in Pinellas Park when she slipped and fell, sustaining injuries. 

As a result, she says she suffered disability, expense of hospitalization and is unable to perform her duties as a wife to John Vanwagner. 

The plaintiffs allege Wal-Mart Stores failed to warn, and protect its patrons from known dangers, or dangers that would be known had Wal-Mart used reasonable care, thus creating an unreasonably dangerous condition for patrons.

The Vanwagners seek trial by jury, damages of at least $15,000 and all just and proper relief. They are represented by attorney Frank DiCosola of Pinellas Park.
