Miramar couple claims Florida Peninsula Insurance failed to pay for water damage to home

FORT LAUDERDALE — Property owners are suing an insurer, citing alleged refusal to apply payments for a covered loss.

Ernest Fieneant and Paulette Fieneant filed a complaint July 13 in the Broward County Circuit Court against Florida Peninsula Insurance Company alleging that the insurer failed to pay the actual cash value of a covered loss.

According to the complaint, the plaintiffs allege that on Jan. 15, their property at 5241 SW 141st Ave. in Miramar suffered a covered loss due to accidental water discharge from a plumbing system, while the insurance policy was in full force and effect, and defendant acknowledged the claim. 

However, Florida Peninsula Insurance allegedly failed and refused to pay the actual cash value for the covered loss, which results in the Fieneants' damages in the amount of the insurance benefits that are due under the terms of the policy. 

The plaintiffs hold Florida Peninsula Insurance Company responsible because the defendant allegedly failed and refused to pay the full amount of the covered loss.

The plaintiffs request a trial by jury and seek damages in excess of $15,000, plus costs, interest, attorney's fees, and other further relief the court may deem just and proper. They are represented by Kenneth R. Duboff of the Duboff Law Firm in North Miami.
