Pinellas County couple alleges Blue Cross violated contract

CLEARWATER — A Pinellas County husband and wife are suing Blue Cross, alleging breach of contract.

Cindy L. Burgdorf and Robert W. Burgdorf filed a complaint July 11 in Pinellas Circuit Court against Blue Cross and Blue Shield of Florida Inc. alleging denying of payments. 

According to the complaint, the Burgdorfs have suffered cost of past medical care, impairment of credit, loss of use of money, and increased expenditures on health care services, due to the wrongful conduct of Blue Cross in denying coverage for advanced imaging tests done at the Mayo Clinic for Robert Burgdorf. 

The plaintiffs allege Blue Cross and Blue Shield of Florida denied payment and/or only partially paid in-network provider services, and forced the Burgdorfs to retain the services of legal counsel for purposes of bringing court action.

The Burgdorfs seek trial by jury, damages in excess of $15,000, plus costs, interest, and attorney fees. They are represented by attorneys Olivia D. Liggio and Jeffrey M. Liggio of Liggio Law PA in West Palm Beach.
