CLEARWATER — A personal representative is suing Boca Ciega Rehabilitation healthcare providers, citing alleged negligence in the death of a resident.
The estate of Freddie Lee Mells, through Thelma L. Mells Ferguson, personal representative, filed a complaint on July 11, in the Pinellas Circuit Court, against the defendants, alleging that they breached their duties to provide care consistent with professional standards.
According to the complaint, the plaintiff alleges that, between June 8, 2016, and Nov. 27, 2017, Freddie Lee Mells was a resident at the nursing home in Gulfport. As a result of defendants' negligence, he suffered injuries, disability, disfigurement, mental anguish and aggravation of a previously existing condition, according to court documents. He died on Dec. 23, 2016.
The plaintiff holds Boca Ciega Rehabilitation responsible because the nursing home allegedly failed to provide a "safe environment, failed to provide adequate and appropriate hygiene and failed to prevent the development of decubitus ulcers," according to court documents.
The plaintiff iis asking for a jury trial, disgorgement of profits, consequential damages, attorneys’ fees and costs, interest and such other relief this court deems appropriate. She is represented by Donna K. Planes of Wilkes & McHugh in St. Petersburg.
