Bay Tree Center accused of failing to provide nursing home resident adequate care

CLEARWATER — A Pinellas County couple is suing a nursing home operator, alleging the deprivation of nursing home residents’ rights.

Ronald Vanhouten and Carol Vanhouten filed a complaint on July 11 in the Pinellas Circuit Court against 2600 Highlands Boulevard North LLC, doing business as  Bay Tree Center, alleging that the nursing home operator breached its duty to provide adequate and appropriate health care and protective support services.

According to the complaint, the plaintiffs allege that, beginning on Sept. 29, 2016, Ronald Vanhouten was a resident at the defendant's nursing home facility for the purposes of receiving skilled nursing care. While under the defendant's care, he developed pressure ulcers and other wounds, which became necrotic and infected, causing him to develop sepsis. The plaintiffs hold 2600 Highlands Boulevard North responsible because the defendant allegedly failed to provide his daily needs, necessary care and treatment; and failed to ensure his right to be free from mental and physical abuse.

The plaintiffs request a trial by jury and seek compensatory damages, together with costs, prejudgment interest, and such other and further relief as the court may deem proper. They are represented by Michael J. Trentalange and Craig M. Harris of Trentalange & Kelley, PA in Tampa.
