CLEARWATER — Two Indian Rocks Beach property owners are suing an insurance company, alleging breach of an insurance contract.

David Cobin and Rhoda Cobin filed a complaint July 9 in Pinellas Circuit Court against Safepoint Insurance Company, alleging failure to pay for the the plaintiffs' full hurricane losses according to the terms of the policy.

According to the complaint, on Sept. 10, 2017, the Cobins' insured property at 2000 Beach Trail Unit 2, Indian Rocks Beach, sustained substantial water damages caused by Hurricane Irma. At the time of the loss, the suit says, the property was insured by Safepoint,

The plaintiffs have claimed payment for the full value of the loss but allege that Safepoint Insurance has failed to pay the full benefits as mandated by the terms of the insurance contract and by Florida law.

The Cobins seek trial by jury, damages in excess of $15,000, exclusive of court costs, attorney fees and interest. They are represented by attorney Paris R. Webb of Arnesen Webb PA in Boca Raton.
