Florida's Mid-Atlantic Finance accuses Tennessee auto dealer of reneging on agreement

CLEARWATER — A Florida financing company is suing a Tennessee auto sales company and its agent, citing alleged refusal to apply payments and unjust enrichment.

Mid-Atlantic Finance Co. Inc. filed a complaint July 10 in the 6th Judicial Circuit of Florida - Pinellas County against Upgrade Auto Sales LLC and Eric Andre Mhoon, alleging that the defendants breached a contract agreement and failed to pay the amount of $29,851.52.

According to the complaint, the plaintiff alleges that on Dec. 1, 2017 Mid-Atlantic Finance entered into an agreement with Upgrade Auto where Mid-Atlantic would purchase certain installment sales contracts from the defendants, who then would buy any "unverified" contracts back. However, Upgrade Auto and Mhoon allegedly failed to buyback the unverified contracts, as stipulated in the agreement. As a result, Mid-Atlantic Finance alleges it is owed $29,851.52 and continues to suffer monetary damages, according to the suit. 

The plaintiff holds Upgrade Auto Sales and Mhoon responsible because they allegedly breached the agreement and guarantee.

The plaintiff requests a trial by jury; and seeks the sum of $29,851.52, together with interest, attorney's fees, costs, and any and all other relief the court deems just and proper. The company is represented by Joelle Schultz of the Law Office of Joelle Schultz PLLC in Clearwater.
