Man alleges he was hurt at Disney's Blizzard Beach water park

ORLANDO — A couple is suing Walt Disney Parks and Resorts US Inc., doing business as Blizzard Beach, a water park, alleging loss of consortium and negligence.

Charles F. Florio and Sylvia V. Florio filed a complaint July 9, in the Orange County Circuit Court against Walt Disney Parks and Resorts US, alleging that its water park failed to follow applicable safety guidelines and regulations.

According to the complaint, the plaintiffs allege that on Aug. 1, 2016, they were visiting the defendant's water park in Orange County, when Charles Florio collided with another rider stuck on the Snow Stormers waterslide attraction. Charles Florio allegedly received a go signal from the attendant to proceed, causing him to suffer bodily injury with resulting pain and suffering, disability, mental anguish, inconvenience, loss of enjoyment of life, medical expenses, loss of earnings, and aggravation of a previously existing condition. Additionally, Sylvia Florio was deprived of the comfort, society and consortium of her husband. 

The plaintiff holds Walt Disney Parks and Resorts US responsible because the defendant allegedly failed to instruct its employees to pay attention to the riders, failed to maintain a proper red light/green light warning system, and failed to warn plaintiff that there was a rider still on the waterslide.

The plaintiffs request a trial by jury; and seeks a judgment against the defendant for damages and all other damages allowable by law, plus costs, post-judgment interest and attorney's fees. They are represented by Brian R. Denney of Searcy Denney Scarola Barnhart & Shipley PA in West Palm Beach.
