ORLANDO — A couple is suing the Orange County School Board, alleging loss of consortium and negligence after the wife tripped and fell on a school sidewalk.
Carmen and Arturo Santisteban filed a complaint July 9, in the Orange County Circuit Court against the Orange County School Board alleging that the school district failed to use due care to maintain its premises in a safe condition.
According to the complaint, the plaintiffs allege that, on Sept. 23, 2014, Carmen Santisteban was visiting Deerwood Elementary at 1356 South Econlockhatchee Trail in Orlando, when she tripped and fell over raised pavement in the parking lot, causing her to suffer injuries, including loss of important bodily function, disfigurement, aggravation of an existing disease, disability, mental anguish, inconvenience, medical expenses and loss of earnings, while her husband and co-plaintiff lost his wife's companionship, comfort, consortium and services.
The plaintiffs hold Orange County School Board responsible because the defendant allegedly failed to warn plaintiff of the dangerous condition on its premises and failed to place any warning signs in the area where the plaintiff fell.
The plaintiffs request a trial by jury; and seek judgment against the defendant for compensatory damages in excess of $15,000, together with costs and prejudgment interest, and any other relief to which the plaintiffs may be entitled.
