CLEARWATER — A condominium association is suing Rymark Contracting Inc., a general contractor, alleging breach of contract.
Eagles Landing Condominium II Association Inc. filed a complaint July 9 in the Pinellas Circuit Court against Rymark Contracting alleging that the company failed to properly repair or replace the exterior siding/wing wall of buildings in the condo development as stipulated by the contract.
According to the complaint, the plaintiff alleges that on Sept. 26, 2017, it made a payment of $89,388.50 to Rymark, money that was to purchase materials for work on its buildings. Rymark allegedly ordered the material for the work, but then failed to pay for it, forcing the association to cover the cost.
Then on Dec. 13, 2017 Rymark stopped all work after the city inspector informed the company that it needed to submit architectural plans with engineer certification for the work. The three buildings that Rymark had partially completed failed the city inspection and the city refused to issue additional work permits, forcing the association to hire another contractor to finish the work.
The plaintiff holds Rymark Contracting responsible because the defendant allegedly failed to submit the required architectural plans with engineer certification, and failed to perform work in a good and workmanlike manner.
The plaintiff requests a trial by jury and seeks damages in excess of $15,000, plus costs and any other relief this court may deem appropriate. It is represented by Stephan C. Nikoloff of Cianfrone, Nikoloff, Grant, Greenberg & Sinclair PA in Dunedin.
