CLEARWATER — St. Petersburg residents are suing Florida Peninsula Insurance Company, alleging breach of an insurance policy.
Wanda Nieves and Angel Nieves filed a complaint July 9 in the Pinellas Circuit Court against Florida Peninsula Insurance Company alleging that the liability insurer failed to perform under the terms of the policy.
According to the complaint, the plaintiffs allege that on March 25, 2017, while the policy provided by defendant was in full force and effect, the Nieves' at 5311 49th St. North in St. Petersburg sustained a covered loss. However, the company failed to adequately cover the loss.
As a result of the defendant's breach, the plaintiffs allegedly have suffered and continue to suffer damages, and were obligated to retain an attorney to prosecute this action. The plaintiffs hold Florida Peninsula Insurance Company responsible because the defendant allegedly failed to properly indemnify them for their losses stemming from the covered peril.
The plaintiffs request a trial by jury; and seek damages in excess $15,000, exclusive of interest, costs and attorneys’ fees and all issues so triable. They are represented by Leo A. Manzanilla of M.S.P.G. Law Group PA in Coral Gables.
