Windermere woman claims Sanford driver caused car accident

ORLANDO — A Windermere resident is suing a driver, citing alleged negligence.

Charia Mayberry filed a complaint July 5 in the 9th Judicial Circuit Court of Florida - Orange County against Dale J. McEllhiney of Sanford alleging that he breached his duty to operate his vehicle in a careful and prudent manner.

According to the complaint, the plaintiff alleges that on May 12, 2017, she was operating her vehicle on Challenger Tech Court at or near its intersection with Challenger Parkway when the defendant struck her vehicle. She suffered bodily injuries; and resulting pain and suffering, disability, disfigurement, mental anguish, and medical care and treatment expenses. The plaintiff holds McEllhiney responsible because the defendant allegedly negligently caused his vehicle to collide with her vehicle.

The plaintiff requests a trial by jury; and seeks damages that exceed $15,000 exclusive of interest, costs and attorney’s fees, and for other such relief to which she is entitled. She is represented by Mark P. Cressman of Mark P. Cressman PA in Winter Garden.
