Apopka homeowners allege contractors did defective work

ORLANDO — Two Apopka homeowners are suing a contractor, alleging breach of contract, negligence and vicarious liability.

Darnell A. Wilson and Mary Lynn Wilson filed a complaint July 5 in Orange County Circuit Court against Meritage Homes of Florida Inc., alleging inadequately installing a stucco system. 

According to the complaint, the Wilsons have suffered damages as a result of the wrongful conduct of Meritage Homes in performing construction work or hiring subcontractors to work on different areas of the plaintiffs' home, 949 Counts Crest Circle, Apopka. The suit says the defendants' shoddy work produced latent defects, including cracking of the stucco, requiring additional repairs and renovations to correct. 

The plaintiffs allege Meritage Homes of Florida failed to comply with all applicable local, state and national building codes and regulations, reduced the value of the Wilson property and failed to adhere to industry standards when painting and sealing around the windows.

The Wilsons seek trial by jury, damages of more than $15,000, plus interest, costs and all other just relief. They are represented by attorneys Neil P. O'Brien, Wil H. Florin, Luca G. Esposito and Kavon P. Smith of Florin Roebig PA in Palm Harbor.
