Osceola Enterprise of Kissimmee failed to warn of pothole that caused fall, invitee alleges

ORLANDO – An invitee of an Orlando shopping plaza alleges a pothole in the parking lot caused her to fall.

Maria Rivera Martinez filed a complaint on July 2 in the 9th Judicial Circuit Court of Florida - Orange County against Osceola Enterprise of Kissimmee Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on Feb. 19, she was a patron at defendant's shopping plaza at 7325 Lake Underhill in Orlando when she tripped and fell because of a pothole in the parking lot and was injured.

The plaintiff holds Osceola Enterprise of Kissimmee Inc. responsible because the defendant allegedly failed to ascertain whether the potholes in the parking lot constituted a hazard to pedestrians utilizing it and failed to adequately warn the plaintiff of the existing danger.

The plaintiff seeks damages of more than $15,000, plus interest and costs, and a trial of all issues so triable. She is represented by Lina M. Lopez of Morgan & Morgan PA in Daytona Beach.
