Wheelchair user alleges leg was fractured while disembarking JetBlue plane

ORLANDO – An airline passenger alleges his leg was fractured as he was being transferred between wheelchairs to disembark a plane.

James Johnson filed a complaint on July 5 in the 9th Judicial Circuit Court of Florida - Orange County against JetBlue Airways Corp. and ABM Aviation Inc., also known as Air Serv, alleging negligence.

According to the complaint, on July 30, 2017, he was disembarking a JetBlue flight in Orlando. Because he is an incomplete quadriplegic, the suit states he required a special wheelchair that could fit in the plane's aisle and then transfer to his regular wheelchair to disembark.

He alleges his leg was fractured in the process of being transferred between wheelchairs by two JetBlue attendees.

The plaintiff holds JetBlue Airways Corp. and ABM Aviation Inc. responsible because the defendants allegedly failed to provide trained personnel to facilitate the transfer of the plaintiff and failed to comply with industry standards for the treatment of passengers requiring assistance.

The plaintiff requests a trial by jury and seeks judgment in of more than $15,000, plus costs of the proceedings. He is represented by Kevin Britt Woods and Kathryn Lee of Woods Trial Law in Tampa.
