Consumer alleges Give Away Auto Sale failed to repair vehicle

CLEARWATER – A St. Petersburg man alleges that a Pinellas Park failed to repair a vehicle he purchased and later unlawfully repossessed it.

Anthony Pascual Torres filed a complaint on June 27 in the 6th Judicial Circuit of Pinellas County against Give Away Auto Sale LLC and Hudson Insurance Co. alleging breach of express and implied warranties.

According to the complaint, the plaintiff alleges on May 29, he purchased a vehicle from the defendant. He alleges the vehicle was advertised at a purchase price of $8,990 but the defendant inflated it to $15,999 in the financing office without the plaintiff's knowledge. He also alleges the defendant refused to accept his insurance and stated it would secure insurance for the vehicle at a cost of $465 to the plaintiff.

The suit states the day after he purchased the vehicle, he was traveling to take the vehicle back to the defendant for repairs when the engine stalled, causing him to spin off of the road and damage the vehicle. He alleges he learned the defendant had failed to bind insurance coverage to the vehicle the same day he purchased it.

The plaintiff alleges the defendant failed to accept his payments and later repossessed the vehicle.

The plaintiff holds Give Away Auto Sale LLC and Hudson Insurance Company responsible because the defendants allegedly failed to repair the vehicle's defects before he purchased it and improperly repossessed it.

The plaintiff seeks judgment against the defendant for compensatory, incidental and consequential damages; attorney's fees; costs; interest; and all other relief as the court deems just. He is represented by Aldo Bolliger of Bolliger Law Group PLLC in Tampa.
