CLEARWATER — Two Clearwater homeowners are suing an insurance carrier, alleging breach of an insurance contract.
Robert J. and Patricia Dragustine filed a complaint June 27 in Pinellas Circuit Court against People's Trust Insurance Company, alleging failure to cover water damages.
According to the complaint, on Dec. 5, 2017, while the plaintiffs' property at 1990 Allard Drive, Clearwater, was insured under a homeowners insurance policy, it sustained a covered loss due to water damage. However, the suit says, despite the efforts of the plaintiffs to provide timely notice of the covered loss and performing all obligations precedent to recover under the policy, People's Trust has refused to provide coverage to the Dragustine dwelling.
The plaintiffs allege People's Trust Insurance has failed to pay for all of plaintiffs’ losses against terms of the insurance policy, and obligated them to retain the services of an attorney to protect their legal interest.
The Dragustines seek trial by jury, judgment of at least $15,000 for all losses with interest on any overdue payments, any incidental and foreseeable consequential damages, plus attorney fees and court costs. They are represented by attorney Logan Templeton of The Nation Law Firm LLP in Longwood.
