Diner alleges restaurant negligence caused her to fall into hole

CLEARWATER — A Pinellas County woman is suing a Clearwater Beach restaurant/bar, alleging negligence in the maintenance of the premises caused her to fall into a hole.

Patricia Sue Kenney filed a complaint June 20 in Pinellas County Circuit Court against Hoot the Dog LLC doing business as The Brown Boxer Pub & Grille, alleging failure to keep a public premises safe for invitees.

According to the complaint, on Dec. 23, 2017, Kenney went into The Boxer Brown Pub & Grille. The suit says Kenney fell in a hole in the floor that had been there long enough for the defendant to have actual knowledge or constructive knowledge of its presence and danger to invitees. 

As a result, Kenney says she suffered permanent injury, disability, pain, medical treatment and expenses for hospitalization. 

The plaintiff alleges The Brown Boxer Pub & Grille failed to maintain the property, thereby creating an unsafe environment for its customers.

Kenney seeks trial by jury, judgment in excess of $15,000, plus costs and all other just relief. She is represented by attorney Frank S. Bianco of New Port Richey.
