ORLANDO — An Orange property owner is suing an insurance carrier, alleging breach of an insurance contract.
Jesus Fernandez filed a complaint June 20 in Orange County Circuit Court against American Integrity Insurance Company of Florida alleging failure to pay for hurricane damage.
According to the complaint, on Sept. 10, 2017, Fernandez's property, 9917 Sweepstakes Lane, apartment No. 1, Orange, sustained a covered loss as a result of Hurricane Irma. However, the suit says, despite the plaintiff's efforts to furnish timely notice of a covered loss, the defendant has refused to pay the full amount of the claim.
The plaintiff alleges American Integrity Insurance has failed to timely evaluate and pay the full amount of the policy benefits owed Fernandez under the terms of the policy, and forced the plaintiff to retain legal services.
Fernandez seeks trial by jury, damages of more than $15,000, including damage to the premises, its contents and loss of use, court costs, interest, attorney fees and all other relief the court deems just. He is represented by attorney Pearl Ben Yoram of Militzok & Levy PA in Hollywood.
