ORLANDO — An Orange County customer is suing a Honda dealer, alleging breach of promise.

Harry Rodriguez filed a complaint June 12 in Orange County Circuit Court against Advance Lenders Services Corp, doing business as XL Auto, alleging the dealer failed to repair the Honda braking system as promised.

According to the complaint, on Dec. 10, 2016, the defendant sold a 2004 Honda Accord to Rodriguez and his brother, Henry Rodriguez Marcelino, without warranty. However, the suit says, XL Auto offered to repair the brakes as necessary.

March 17, 2017, Rodriguez says he was a passenger in the Honda when it was involved in a single vehicle crash due to brake failure. Rodriguez alleges he sustained bodily injury and resulting pain and suffering, disability, disfigurement, and hospitalization and medical expense.

The plaintiff alleges XL Auto, despite several appointments to have the brake work completed, failed to do so.

Rodriguez seeks trial by jury, damages, plus interest and costs of these proceedings. He is represented by attorney Shawn A. Jiles of Jiles Law PA in Winter Haven.
