Trustee sues Universal Property & Casualty Insurance Company

ORLANDO — A trustee is suing Universal Property & Casualty Insurance Company, an insurer, citing alleged breach of contract.

Peter Sealey filed a complaint on June 20 in Orange County Circuit Court against Universal Property & Casualty Insurance Company alleging that the insurer breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that on Feb. 20, 2017, he sustained damage to property as a result of a pipe burst during the insurance policy period, which the defendant refused to provide coverage for. 

The plaintiff holds Universal Property & Casualty Insurance Company responsible because the defendant allegedly failed or refused to fully perform under the policy, fully value plaintiff’s losses and failed to fully pay for all of plaintiff’s losses as required by the insurance policy.

The plaintiff requests a trial by jury and seeks judgment against defendant for plaintiff’s losses with interest on any overdue payments, attorney's fees and costs. He is represented by David A. Spain of Morgan & Morgan PA in Orlando.
