ORLANDO — A husband and wife are suing Heritage Property and Casualty Insurance Company, an insurer, citing alleged breach of contract.
Ronida and Guillermo Repiedad filed a complaint on June 12 in Orange County Circuit Court against Heritage Property and Casualty Insurance Company alleging that the insurer breached its duty of good faith and fair dealing.
According to the complaint, the plaintiffs allege that on May 4, 2017, Ronida and Guillermo Repiedad suffered damages to their insured property as a result of wind, tropical storm or other events that should be covered under the policy, to which the defendant denied coverage for insurance claim to the detriment of plaintiffs.
The plaintiffs hold Heritage Property and Casualty Insurance Company responsible because the defendant allegedly failed to make any payment of insurance proceeds and obligated plaintiffs to retain an attorney to prosecute their case.
The plaintiffs request a trial by jury and seek judgment against defendants for damages in excess of $15,000 plus interest, costs and attorney's fees. They are represented by Rand Saltsgaver of Law Offices of Rand Saltsgaver in Orlando and Charles Parker Jr. of Mapp & Parker PA in Orlando.
