Orlando homeowners association accuses property owners of illegal parking

ORLANDO — An Orlando subdivision association is suing property owners and tenants, alleging breach of contract due to illegal parking.

Heather Glen at Meadows Woods Homeowners Association Inc. filed a complaint June 12 in Orange County Circuit Court against Josefa Antonia Briceno Barrios, Indira Joselayne Chavez Briceno, tenant one and tenant two, alleging the defendants knowingly violated the association's declaration of covenants and restrictions by parking illegally.

According to the complaint, between Aug. 23, 2017-Feb. 12, 2018, Heather Glen at Meadows Woods Homeowners Association managed a real property at 13135 Ashington Pointe Drive, Orlando, which was owned Barrios and Briceno and rented by the two other defendants. On several occasion, the suit says, the defendants parked on the lawn and in the street in violation of the declaration of covenants and restrictions, which prohibit lawn parking and restricts parking of vehicles to the driveway and/or garage. 

The association has demanded the defendants comply and has provided notices of the violations. However, the plaintiffs say, the defendants have refused to comply. As a result, the association has been damaged. 

The plaintiff alleges the defendants knowingly violated the association's declaration of covenants and restrictions by illegally parking on the lawn and street.

Heather Glen at Meadows Woods Homeowners Association seeks trial by jury, a preliminary and permanent injunction, monetary damages, including court costs, interest, attorney fees and all other just and proper relief.
