Assisted living facilities, management, staff cited in patient's wrongful death

CLEARWATER — The heirs of a deceased patient are suing a St. Petersburg assisted living and nursing care facilities, management and staff, alleging insufficient measures were taken to prevent injuries and loss of consortium.

CLEARWATER — The heirs of a deceased patient are suing a St. Petersburg assisted living and nursing care facilities, management and staff, alleging insufficient measures were taken to prevent injuries and loss of consortium.

The estate of Jennie C. Healy, by and through Michael M. Healy and Suzanne M. Rieber, filed a complaint June 12 in Pinellas County Circuit Court against Bon Secours Place at St. Petersburg, LLP, Life Care Services, LLP, et al., alleging the defendants negligently failed to exercise due care in providing the best care and support.

According to the complaint, between Jan. 28, 2016, and May 11, 2017, Jennie Healy was at Bon Secours Place in St. Petersburg, admitted as a patient and resident with special assisted needs.

The suit says at the facility Healy sustained falls, which caused her bodily injuries, resulting in pain, suffering, infections, disability, mental anguish, additional expenses for medical care and treatment and aggravation of previously existing conditions that eventually caused her wrongful death. 

As a result, the suit says, her heirs have suffered loss of support, companionship, mental and emotional pain and incurred extensive medical, nursing and funeral expenses. 

The plaintiffs allege the defendants negligently failed to exercise due care in providing the best care and support to patients' needs resulting in wrongful death and violation of the Adult Protective Services Act.

Michael Healy and Rieber seek trial by jury, damages in excess of $15,000, excluding disgorgement of profits, attorney fees, court costs, interest and all other relief the court deems appropriate. They are represented by attorney Donna K. Hanes of Wilkes & McHugh, PA in St. Petersburg.
