CLEARWATER — A resident of a senior care facility is suing the facility, its agents and its employees, citing alleged breach of duty, insufficient measures were taken to prevent injuries, and vicarious liability.
Beverly H. Vignochi by and through Attorney-in-Fact Tia Vignochi Lambert filed a complaint on June 4 in the 6th Judicial Circuit of Florida-Pinellas County against Swanholm Central, LLC, WKRM Development, LLC, et al. alleging that the defendants failed to exercise reasonable care in supervising, assisting and preventing injuries.
According to the complaint, the plaintiffs allege that between July 5, 2015, and Sept. 20, 2017, Beverly H. Vignochi by and through Attorney-in-Fact, Tia Vignochi Lambert Beverly was admitted in the senior care facility at 6280 Central Ave. in St. Petersburg as an elderly person with special assistance needs. While in the facility, she allegedly had multiple falls resulting in severe injuries, skin tears and abrasions, hematoma, infections, pneumonia and diarrhea, causing her pain, suffering, disability, mental anguish, additional expense of hospitalization and aggravation of pre-existing conditions.
The plaintiffs holds Swanholm Central, LLC, WKRM Development, LLC, et al. responsible because the defendants allegedly failed to exercise reasonable care in properly supervising, assisting and preventing injuries to residents in the facility.
The plaintiffs request a trial by jury and seek damages in excess of $15,000, exclusive of costs, interest, attorney's fees and such other relief the Court deems just and appropriate. They are represented by Lisa M. Tanaka of Wilkes & McHugh, PA in St. Petersburg.
