Orlando homeowner alleges insurer failed to cover water damage

ORLANDO — An Orlando homeowner is suing an insurance company, alleging breach of an insurance contract.

Mario Antonio Tolentino filed a complaint May 30 in Orange County Circuit Court against Foremost Insurance Company, alleging failure to perform its obligations under the terms of the insurance policy regarding water damage.

According to the complaint, on Jan. 18, Tolentino's property at 4724 Bunting Ave., Orlando, sustained water damage while the policy issued by Foremost defendant was in full force and effect.

After a disagreement regarding the evaluation of the loss, the suit says,Tolentino requested supplemental payment, which the defendant refused to provide. The plaintiff alleges Foremost Insurance, despite acknowledging that the property sustained a covered loss and has offered payment, has failed and refused to make additional payments.

Tolentino seeks trial by jury, damages of more than $15,000, pre-judgment interest, attorney fees and court costs. He is represented by attorneys Stephanie Balint and Robert L. Gioia of Homeowner Legal Solutions LP in Plantation.
